1. INTRODUCTION

At SMYE Fine Jewellery ("SMYE", "Company", "we", "our" or "us"), every piece of jewellery is carefully designed, crafted and inspected to meet our quality standards. Owing to the handcrafted nature of fine jewellery and the unique characteristics of precious metals and gemstones, certain natural variations may occur and should not be regarded as defects.

This document is intended to provide customers with important information regarding our products, their characteristics and certain inherent limitations associated with handcrafted fine jewellery.

These disclosures should be read together with our Terms of Use, Shipping & Delivery Policy, Return, Refund & Cancellation Policy, Warranty & Repair Policy and other policies published on our website..

2. PRODUCT REPRESENTATIONS

We endeavour to ensure that all product descriptions, specifications, photographs and other information displayed on our website accurately represent our products.

However, product images are intended for illustrative purposes only and may differ slightly from the actual product due to factors including lighting conditions; professional photography; image enhancement; screen resolution; colour calibration of individual devices; browser settings; and viewing angle.

Accordingly, minor variations in colour, finish or appearance shall not be regarded as defects.

3. HANDCRAFTED JEWELLERY

Many SMYE products are handcrafted by skilled artisans.

Accordingly, slight variations in finish; polishing; engraving; stone setting; symmetry; texture; and overall appearance are inherent characteristics of handcrafted jewellery and contribute to the uniqueness of each piece.

Such variations do not indicate poor workmanship or manufacturing defects.

4. PRECIOUS METALS

Our jewellery may be manufactured using precious metals including gold and sterling silver.

The purity of precious metals shall be as described on the relevant product page.

Due to accepted manufacturing tolerances the actual metal weight may vary slightly from the weight displayed; dimensions may differ marginally from stated specifications; and handcrafted finishing may result in minor variations between products.

Such variations are commercially accepted within the jewellery industry.

5. PRODUCT WEIGHT & DIMENSIONS

Unless expressly stated otherwise, all weights, measurements and dimensions displayed on the website are approximate.

The final weight of a finished jewellery product may vary owing to manufacturing processes; polishing; gemstone setting; design variations; handcrafted finishing; and accepted industry tolerances.

Customers acknowledge that minor variations in weight or dimensions shall not constitute a defect.

6. GEMSTONES

Natural gemstones are products of nature.

Accordingly, individual gemstones may differ in colour; clarity; inclusions; texture; pattern; shape; and brilliance.

No two natural gemstones are identical.

These natural characteristics enhance the uniqueness of each jewellery piece and shall not be treated as manufacturing defects.

7. LAB-GROWN DIAMONDS

Where specifically stated, certain products may contain lab-grown diamonds.

Lab-grown diamonds are genuine diamonds created through controlled technological processes and possess substantially the same physical, chemical and optical properties as natural diamonds.

They differ from natural diamonds only in their origin and may differ in market valuation and resale characteristics.

Customers are encouraged to carefully review product descriptions before placing an order to ensure that they have selected the desired category of diamond.

8. HALLMARKING & CERTIFICATION

Where required under applicable law, gold jewellery shall bear the appropriate Bureau of Indian Standards (BIS) Hallmark.

Products may also be accompanied by certificates issued by recognised gemological laboratories or certification agencies, where applicable.

Such certificates represent the opinion of the issuing authority and should be read together with the accompanying documentation.

Customers are advised to retain all certificates, invoices and authenticity documents for future reference, warranty claims or resale purposes.

9. PRODUCT AVAILABILITY & DESIGN MODIFICATIONS

SMYE continually reviews and updates its product catalogue.

Accordingly, products may be modified, discontinued or replaced without prior notice.

Minor design refinements, manufacturing improvements or changes in production techniques may be introduced from time to time without materially altering the overall appearance or quality of the product.

Where such changes become necessary after an order has been placed, SMYE shall endeavour to notify the customer where the changes are material.

10. JEWELLERY CARE

Fine jewellery is delicate by nature and should be handled with appropriate care to preserve its appearance and longevity.

Customers are encouraged to:

  • store jewellery individually in a clean, dry and secure place;
  • use the original jewellery box or a soft-lined storage case where possible;
  • clean jewellery using a soft, lint-free cloth or in accordance with the care instructions provided by the Company;
  • remove jewellery before engaging in activities that may expose it to impact, abrasion or excessive force; and
  • periodically inspect stone settings and clasps to ensure that they remain secure.

Proper care and maintenance significantly contribute to the longevity and appearance of jewellery.

11. EXPOSURE TO CHEMICALS & ENVIRONMENTAL CONDITIONS

The appearance and finish of jewellery may be affected by exposure to certain chemicals and environmental conditions.

Customers are advised to avoid unnecessary exposure of jewellery to perfumes and deodorants; cosmetics and skincare products; hair sprays; chlorine and swimming pools; seawater; household cleaning agents; bleach and harsh chemicals; excessive moisture; extreme temperatures; and abrasive surfaces.

Such exposure may result in discolouration, loss of lustre, wear of protective finishes or deterioration of certain gemstones and shall not ordinarily constitute a manufacturing defect.

12. NORMAL WEAR & TEAR

Fine jewellery is intended for regular use and, over time, may naturally exhibit signs of wear consistent with normal usage.

Examples of normal wear include minor surface scratches; gradual polishing wear; slight loosening of clasps due to regular use; natural patina on precious metals; minor abrasions; and ordinary ageing associated with the passage of time.

Such changes are inherent to jewellery ownership and shall not, by themselves, be regarded as defects in materials or workmanship.

13. RING SIZES & PRODUCT FIT

Customers are responsible for ensuring that the ring size, chain length, bracelet size or other measurements selected at the time of purchase are accurate.

Size guides provided on the website are intended solely as general guidance.

Minor variations in fit may occur depending upon the design, width, profile or construction of the jewellery.

Where resizing services are available, such services shall be governed by SMYE's Warranty & Repair Policy and any applicable charges communicated to the customer.

14. METAL SENSITIVITY & ALLERGIC REACTIONS

Individual sensitivity to precious metals may vary.

Although SMYE endeavours to use quality materials consistent with the product specifications, customers with known metal allergies or sensitivities are encouraged to carefully review the composition of the jewellery before making a purchase.

SMYE shall not be responsible for allergic reactions arising from an individual's personal sensitivity to specific metals or alloys, except where required by applicable law.

Customers with specific concerns are encouraged to contact SMYE before placing an order.

15. THIRD-PARTY ALTERATIONS & REPAIRS

Jewellery should, wherever reasonably possible, be serviced, repaired or altered only by SMYE or by persons expressly authorised by SMYE.

Repairs, resizing, polishing, engraving or other alterations carried out by third parties may alter the structural integrity of the jewellery; affect gemstone settings; change product specifications; impact hallmarking or certification; or affect the applicability of warranty coverage. SMYE shall not be responsible for defects, damage or deterioration resulting from unauthorised alterations or repairs carried out after delivery.

16. LOSS OF STONES

Although every effort is made to ensure the secure setting of gemstones, prolonged use, accidental impact or improper handling may result in the loosening or displacement of stones over time.

Customers are encouraged to periodically inspect their jewellery and seek professional inspection if any stone appears loose.

Loss of gemstones resulting from accidental impact, misuse, unauthorised repairs or ordinary wear shall not ordinarily constitute a manufacturing defect.

Where stone replacement or repair services are available, such services shall be governed by SMYE's Warranty & Repair Policy.

17. STORAGE OF JEWELLERY

When not in use, jewellery should be stored separately from other pieces to minimise scratching and abrasion.

Customers are encouraged to avoid storing multiple pieces together; keep jewellery away from excessive humidity and direct sunlight; use individual pouches or compartments where available; and retain original packaging for long-term storage and transportation.

Proper storage helps preserve the finish and structural integrity of jewellery.

18. PERIODIC INSPECTION & MAINTENANCE

SMYE recommends that frequently worn jewellery be periodically inspected to verify the condition of stone settings, clasps, hinges and other functional components.

Routine maintenance may assist in identifying wear before it develops into more significant damage.

The need for periodic maintenance is a normal characteristic of fine jewellery ownership and should not be interpreted as indicating any manufacturing defect.

19. CUSTOMISED & BESPOKE JEWELLERY

SMYE offers customers the opportunity to personalise and customise certain jewellery products, including engraving, gemstone selection, precious metal selection and bespoke jewellery designs.

Due to the personalised nature of such products:

  • slight variations between design concepts, computer-generated renderings and the finished handcrafted product may occur;
  • handcrafted techniques and manufacturing processes may result in minor differences in finish, proportions or appearance;
  • customised products are created specifically for the customer and may therefore be subject to separate terms relating to cancellation, returns and exchanges.

Such variations are inherent to the process of handcrafted jewellery manufacturing and shall not, by themselves, constitute manufacturing defects.

20. CUSTOMER-SUPPLIED DESIGNS

Where customers submit sketches, photographs, reference images, concepts or other design materials for the purpose of manufacturing customised jewellery, the customer represents that they possess the necessary rights and permissions to use such materials.

SMYE shall be entitled to rely upon such representation and shall not be under any obligation to independently investigate the ownership or originality of customer-submitted materials. SMYE reserves the right to decline any request that, in its reasonable opinion, may infringe the intellectual property rights of third parties or otherwise expose SMYE to legal or commercial risk.

21. ENGRAVING & PERSONALISATION

Customers are solely responsible for reviewing and confirming the accuracy of all engraving instructions, including names, initials, dates, symbols, messages and other personalised content, prior to placing an order.

Once engraving or personalisation has commenced, changes may not be possible.

SMYE shall not be responsible for errors arising from incorrect or incomplete information provided by the customer.

22. PRICE FLUCTUATION OF PRECIOUS METALS

The prices of precious metals, diamonds and gemstones are subject to continuous market fluctuations.

Accordingly product prices displayed on the website may change without prior notice until an order has been confirmed; future market prices shall not affect the purchase price of products already purchased; and any refund approved under the Company's policies shall ordinarily be calculated based on the original purchase price paid by the customer and not the prevailing market value of precious metals or gemstones.

23. INVESTMENT DISCLOSURE

Jewellery offered by SMYE is intended for personal use, gifting and adornment.

Nothing contained on the website, in product descriptions, promotional materials or other communications should be construed as investment advice, financial advice or a representation regarding the future appreciation, resale value or investment performance of any jewellery product.

The future market value of precious metals, diamonds and gemstones is influenced by numerous factors beyond SMYE's control.

24. PRODUCT PHOTOGRAPHY & DIGITAL CONTENT

All photographs, videos, product renderings, catalogues, graphics, website content and other visual materials displayed on the website are the exclusive property of SMYE or are used under valid licence.

25. PRODUCT DESIGNS & CAD FILES

Unless otherwise expressly agreed in writing, all product designs, computer-aided design (CAD) files, renderings, technical drawings, manufacturing specifications and other design- related materials created or developed by SMYE shall remain the exclusive intellectual property of SMYE.

Nothing contained in the purchase of a jewellery product shall be construed as transferring ownership of the underlying design, CAD files or other proprietary materials.

26. INTELLECTUAL PROPERTY RIGHTS

The trademarks, trade names, logos, product names, artwork, designs, website content, graphics, software, text, compilations and other intellectual property appearing on the website are owned by or licensed to SMYE.

Except as expressly permitted by applicable law or with SMYE's prior written consent, no person shall reproduce, modify, distribute, publish, commercially exploit or otherwise use any part of SMYE's intellectual property.

27. PRODUCT AUTHENTICITY & UNAUTHORISED SALES

SMYE guarantees the authenticity of its products only when purchased directly through the Company's official website or through sales channels expressly authorised by SMYE.

SMYE does not authorise the sale of its products through unauthorised dealers, resellers or other third-party platforms unless expressly announced by SMYE.

Accordingly, SMYE cannot verify the authenticity, quality, condition or provenance of products purchased from unauthorised sources and shall not be responsible for any claims, losses or disputes arising from such purchases.

Customers are encouraged to retain their original purchase invoice, authenticity certificates, warranty documentation and other supporting records, as these may be required to establish the authenticity of the product and to facilitate warranty services, repairs or other after-sales support.

If any person has reason to believe that a product bearing the Company's name, logo or branding is counterfeit, unauthorised or otherwise infringes the Company's intellectual property rights, they are encouraged to promptly notify SMYE by providing all available details, including photographs, purchase information and the identity of the seller, wherever available.

SMYE reserves all rights to take appropriate civil, criminal or other legal action against any person involved in the manufacture, distribution, sale or promotion of counterfeit products or any unauthorised use of its intellectual property.

28. PRODUCT INFORMATION

SMYE endeavours to ensure that product descriptions, specifications, pricing and other information displayed on the website are accurate at the time of publication.

However, occasional typographical errors, inadvertent inaccuracies or omissions may occur. SMYE reserves the right to correct such errors and, where necessary, update product information without prior notice.

Where any material error affects an order already placed, the customer shall be informed and provided with an appropriate opportunity to proceed with or cancel the order.

29. LIMITATION OF REPRESENTATIONS

Except as expressly stated in SMYE's published policies or as required under applicable law, no statement, illustration, promotional material or communication shall be construed as creating any warranty, guarantee or representation beyond those expressly provided by SMYE.

Nothing contained in this document shall limit any statutory rights available to consumers under applicable law.

This document should be read together with SMYE’s Terms of Use; Privacy Policy; Cookie Policy; Shipping & Delivery Policy; Return, Refund & Cancellation Policy; and Warranty & Repair Policy.
